Alleged Breach: Court Fixes Date For Trial Of MTN’s CEO, Others

The Federal High Court sitting in Abuja has slated May 28 for the Federal Competition and Consumer Protection Commission, FCCPC, to arraign the Managing Director and Chief Executive Officer, MD/CEO, of MTN Nigeria Communications Plc, Mr Karl Toriola, on a two-count charge.

Others listed as 1st to 4th defendants in the charge marked: FHC/ABJ/CR/354/2024, are;
MTN Nigeria Communications Plc, the Chief Corporate Services and Sustainability Officer of the company, Tobechukwu Okigbo, as well as its General Manager, Regulatory Affairs, Ikenna Ikeme.

The defendants were alleged to have failed to produce vital documents and information the Federal Government requested through the FCCPC.

The prosecution maintained that the action of the defendants was in beach of the FCCPC Act.

The charge, which is before trial Justice
H.J. Yilwa, was filed through a team of lawyers led by Mr. Akoji Achimugu.

The Attorney-General of the Federation and Minister of Justice, Prince Lateef Fagbemi, SAN, had earlier applied to takeover another three- count charge that was instituted against the telecommunication company by the Nigerian Copyright Commission, NCC.

Aside from Toriola, MTN’s Senior Executive Officer, Nkeakam Abhulimen; Fun Mobile Ltd, a telecommunications service provider, as well as its CEO, Yahaya Maibe, were listed as defendants in the charge marked: FHC/ABJ/CR/111/2024.

The prosecution alleged that the defendants, between 2010 and 2017, “offered for sale, sold and traded for business, infringed musical works of Maleke Moye, an artiste, without his consent and authorisation.”

The NCC alleged that the defendants used Maleke’s musical works and sound recordings with subsisting copyright, known as “caller ring back tunes” without the authorisation of the artiste.

The musical works and sound recordings of the musician allegedly infringed upon included “911, Minimini-Wana Wana, Stop Racism, Ewole, 911 instrumental, Radio, Low Waist, and No Bother.”

They were also alleged to have illegally distributed the musical works to their subscribers, without authorisation, thereby infringing on the rights of the artiste.

In count three of the charge, the defendants were alleged to have had in their possession, the musical works and sound recordings of the artiste, other than for their personal or domestic use.

The copyright commission said the alleged offence is punishable under Section 20 (2) (a) (b) and (c) of the Copyright Act, Cap. C28, Laws of the Federation of Nigeria, 2004.

Trial Justice Inyang Ekwo adjourned the matter till May 15, following AGF’s application to takeover the case.

Fire Destroys Radio Studio In Oyo

A fire outbreak has destroyed the radio studio of Ajayi Crowther University in Oyo State, resulting in the loss of equipment and property worth millions of naira.

The incident occurred on Monday within the university campus.

According to reports, the fire was triggered by an electrical surge from the studio’s air-conditioning system.

The blaze quickly spread through the facility before firefighters arrived to contain it.

Confirming the incident, the Chairman of the Oyo State Fire Service, Maroof Akinwande, in a statement on Tuesday, said firefighters led by PFS 11 Makinde quickly responded to the call.

When they arrived, the studio was engulfed in flames and smoke. They managed to stop the fire from spreading to other areas.

“No casualty was recorded, and we were able to save properties worth millions of naira,” Akinwande said.

He advised the public to always have fire extinguishers and use them properly to stop small fires before they spread.

Recall that on August 16, in a statement signed by the Group Head of Corporate Affairs, Fresh FM Nigeria and Yinka Ayefele Limited, Samson Akindele, confirmed a fire outbreak gutted its head office at Challenge, Ibadan.

This fire outbreak comes only a few days after a similar incident occurred at Fresh 105.9 FM in Ibadan.

VIDEO: Fatal Accident Spurs Traffic Jam On Lagos Road

A fatal road crash on Tuesday that claimed the life of a passenger and left two others injured, has caused heavy traffic along the Idi-Iroko inward Ogolonto axis of Ikorodu Road, Lagos.

The General Manager of the Lagos State Traffic Management Authority, Olalekan Bakare-Oki, confirmed the incident in a statement signed by the agency’s Director of Public Affairs and Enlightenment Department, Taofiq Adebayo.

According to LASTMA, the crash involved a commercial bus and a truck, with one victim crushed to death after being flung from the bus. Emergency responders conveyed the injured to the Ikorodu General Hospital while efforts were made to ease the traffic gridlock that had built up along the busy corridor.

According to The PUNCH, incident comes barely 24 hours after another crash at the Ibeju Bus Stop on the Lekki–Epe Expressway claimed six lives and left nine others injured.

Six Killed, Nine Injured In Fatal Crash On Lekki–Epe Expressway

Six people were confirmed dead, and nine others sustained injuries in a road accident at Ibeju Bus Stop along the Lekki–Epe Expressway in Lagos State.

The Lagos State Traffic Management Authority said the crash occurred on Monday when a blue Volvo FL6 truck loaded with wooden planks rammed into a white commercial bus with registration number AKD 336 YD.

The fatalities included two men, three women, and a child. Four other occupants of the bus escaped unhurt.

LASTMA’s Director of Public Affairs and Enlightenment, Adebayo Taofiq, said officials, with support from other emergency responders, swiftly rescued the survivors.

“The nine injured survivors were swiftly extricated by LASTMA officials with support from other emergency responders and immediately conveyed to the Federal Medical Centre (FMC) Epe and Hammond Hospital for urgent medical attention.”

He added that LASTMA worked in collaboration with the Federal Road Safety Corps, the Nigeria Police Force, and the Lagos Neighbourhood Safety Corps to evacuate victims and clear the accident scene.

LASTMA General Manager, Olalekan Bakare-Oki, condoled with the bereaved families and cautioned motorists against reckless driving, particularly overspeeding. He urged drivers to remain vigilant, obey traffic laws, and avoid distractions, especially during the Ember Months, a period known for frequent road crashes.

He added that the remains of the deceased had been deposited at the FMC morgue in Epe, awaiting formal identification by their families.

Taofiq said the four unhurt survivors received immediate attention from the LASTMA Rescue Unit, working with other agencies.
