N3.6bn Fraud: EFCC Seeks Court Order To Arrest Ex-NDDC Boss

The Economic and Financial Crimes Commission has approached a Federal High Court sitting in Ikoyi, Lagos State, seeking a court warrant of arrest for a former Executive Director on Projects, Niger Delta Development Commission, Tuoyo Omatsuli, over an alleged N3.6bn fraud case.

The anti-graft agency revealed that its reason for approaching the court was to compel Omatsuli to attend his trial over the money laundering allegation.

The commission noted that Omatsuli and his co-defendants, rather than opening their defence, filed a no-case submission, which was heard on October 12, 2020, after the EFCC called 16 prosecution witnesses, and subsequently closed its case against the defendants for them to open their defence.

The spokesperson for the EFCC, Dele Oyewale, revealed the development in a statement on Thursday.

Oyewale said, “The EFCC, on Wednesday, January 31, 2024, prayed Justice Daniel Osiagor of the Federal High Court sitting in Ikoyi, Lagos to issue a warrant of arrest to compel a former Executive Director on Projects, Niger Delta Development Commission,  Tuoyo Omatsuli, to attend his trial over an alleged N3.6bn fraud.

“Omatsuli, alongside Francis Momoh, Don Parker Properties Limited and Building Associates Limited, were initially standing trial on an alleged case of conspiracy and money laundering to the tune of N3,645,000,000 before retired Justice Saliu Saidu of the Federal High Court, Ikoyi, Lagos.”

One of the counts read, “That you, Tuoyo Omatsuli, Don Parker Properties Limited, Francis Momoh and Building Associates Limited, between August 2014 and September 2015 at Lagos, within the jurisdiction of this Honourable Court, conspired to disguise the illegal origin of N3,645,000,000, being proceeds of unlawful activity to wit: corruption and gratification; and thereby committed an offence contrary to Section 18 of the Money Laundering Act 2011 as amended by Act No 1 of 2012 and punishable under Section 15 (3) of the same Act.”

Another count read, “That you, Tuoyo Omatsuli, between August 2014 and September 2015 at Lagos, within the jurisdiction of this Honourable Court, did procure Francis Momoh and Building Associates Limited to use the total sum of N3,645,000,000 paid by Starline Consultancy Services into the Diamond Bank Plc Account No. 0023785116 operated by Building Associate Ltd, when you reasonably ought to have known that the said sum formed part of the proceeds of your unlawful activity to wit: Corruption and Gratification; and you thereby committed an offence contrary to Section 18 of the Money Laundering Act 2011 as amended by Act No 1 of 2012 and punishable under Section 15 (3) of the same Act.”

He, however, noted that they pleaded not guilty to the charges preferred against them.

Oyewale added, “The EFCC, after calling 16 prosecution witnesses, subsequently closed its case against the defendants.  However, rather than open their defence, the defendants filed a no-case submission, which was heard on October 12, 2020.

“In his ruling on November 11, 2020, Justice Saidu discharged the first defendant, Omatsuli, saying, ‘I have gone through the charge preferred against the defendants as well as the evidence of all the 16 prosecution witnesses and I found no reason for the first defendant to enter the defence’.”

He further revealed that the EFCC appealed the ruling, adding that the Court of Appeal, on April 13, 2022, upheld the appeal of the EFCC, and dismissed the earlier ruling of the trial court.

Oyewale noted, “Consequently, the EFCC vowed to appeal the discharge of the former NDCC boss.  On April 13, 2022, a three-man panel of the Court of Appeal, Lagos Division,  upheld the appeal of the EFCC and dismissed the ruling of the trial court.

“The judgment delivered by Justice Festus Ogbuinya held that the ruling of the lower court dated November 11, 2020, discharging the respondent, Omatsuli, of the money laundering charges ‘is hereby set aside and he shall enter into his defence accordingly on the same counts.

“The Appellate Court, however, discharged Omatsuli on counts 27, 28 and 29 of the charge. In the course of the trial, Justice Saidu retired and the matter was subsequently re-assigned to Justice Osiagor.”

He noted that at the resumed sitting on Wednesday, counsel for the second defendant, Norrison Quakers, SAN informed the court that Omatsuli was absent in court because he had an appeal pending before the Supreme Court.

Traders In Edo Protest Middlemen Activities, Seek Govt Intervention

Traders under the auspices of Ekiosa Market Traders Association, on Monday protested what they tagged activities of ‘evil middlemen and women’, which according to the protesters are causing price hike and artificial scarcity in Benin markets.

The protesters also protested against the neglect of their market (Ekiosa Market)by concerned authorities, which according to them got burnt in 2019.

The protesters who carried placards with different inscriptions as ‘evil union in Edo market are responsible for hike in food;’ Edo people say no to evil union in our market;’ Edo State government ban evil union in Edo markets;’ ‘we say no to evil union in Edo market,’ lamented that many of them are stranded due to government failure to rebuild their market that got burnt, adding that the middlemen and women are making them unproductive.

Speaking during a peaceful protest to the secretariat of the Nigeria Union of Journalists (NUJ), Edo State council, Lucky Orukpe, President of Traders Welfare Union, accused the middlemen and women of causing artificial scarcity in Edo market and also price hike in farm produce.

He alleged that these middlemen and women who form unions among themselves are making sure that whoever fails to join their union does not have a place to sell in the market in Benin City.

He said: “Today, in our market, if you bring your farm produce to sell, we have people we call middlemen and women in our market in Edo State. They will compel you to join a union before you can sell your garri; they will compel you to join their union before you can sell your yam.
If you are not in their union, and you are bringing produce to sell, no vehicle will carry you. When they succeed in compelling you to join their union, they give you time to come to their market.

“Today, farmers are scared to bring farm produce to the market. So, these evil unions are causing artificial scarcity in our market in Edo State.”

Ourkpe who alleged that the ‘evil middlemen and women just devised a new means of operation recently, lamented that due to their activities, food prices are lesser in states that Edo supplies food.

He further lamented: “We carry food from Edo State to other states but food is cheaper in these states, this is because of the activities of these middlemen.”

Ourkpe who said these men are not government agents but individuals, urged the state government to as a matter of urgency address the issue before it got out of hand.

On his part, Anthony Agho, president, Ekiosa Market Traders Association, lamented “we the Ekiosa Market traders are stranded in the streets. We have no where to trade. And they forbid us from selling on the walkway, so how are we going to survive.

He continued: “In 2019, Ekiosa Market got burnt, and since then we have been managing. In 2020, Oredo Local Government came and said we should leave the place and that they want to renovate it. Then in January 2024, the local government came and told us that we should leave and that between 4 months the work will be completed, and since then we have been waiting.”

Amadasun Owns Landed Property Situated At Zone MD Obazagbon, Benin Court Rules

A Benin High Court presided over by Hon Justice A.N. Erhabor has issued a certificate of “execution of warrant of possession” to Mr Frank Omo- Amadasun in order to take full possession of his landed property situated at Zone MD/A44/OBAZAGBON in lkpoba Okha Local Government Area of Edo State.

In 2021, some persons encroached the landed property measuring 1,000 feets by 1,000 feets in Obazagbon near Avbiama in Ikpoba okha local government area of Edo state.

The land acquired in 1979, was in full control of the complainant before its encroachment.

This forced Amadasun to institute a legal procedure against those who encroached on his land including Johnson Akpobosa, Peter Akpobosa, Abel Oyo Akpobosa l, Mrs Omoruyi, Mrs Oronsaye and 11 unknown persons.

In the case marked: No.B/975/2021, there was consequently an enrolment of order where the judge granted an interlocutory injunction restraining all the defendants/ respondents, their servants, agents, or any person howsoever described as acting on their behalf or instruction from further trespassing on the piece or parcel of land measuring approximately 1,000 feets by 1,000 feets known as plot 53351 lying and situate at Zone MD/A44/OBAZAGBON, lkpoba Okha Local Government Area of Edo State pending the hearing and determination of the substantive suite before the court.

But despite the restraining order, the defendants went ahead to start developing property in the land.

In the judgement, the court confirmed that Mr Amadasun has a verifiable Certificate of Occupancy to the land with digital registrar in the EDOGIS.

The court also confirmed that the claimant is the rightful owner in possession of 1,000 feets by 1,000 feets bounded by Beacon numbers 542, 543, 544 and 454 which covers an area measuring approximately 8, 557 hectares now known as plot 53351, lying and situate at Obazagbon in lkpoba Okha Local Government Area of Edo State.

After the judgement, the claimant, then got a certificate of execution of a warrant of possession which has been fully executed.

Contacted , the Edo state Police Public Relations Officer, SP Chidi Nwabuzor said the police received a letter from the Deputy Director of the High Court to execute the court order over the land.

SP Chidi Nwabuzor said the Edo state Commissioner of Police , CP Funsho Adegboye has since ordered men of the Anti Kidnapping And Cybercrime Unit of the Edo State Police Command to take over the judgement execution order.

As at Press time, the claimant has since taken over the full possession of the land as ordered by the court but not without resistance by some persons in Obazagbon in Ikpoba Okha local government area of Edo state.

Ex-First Bank Chairman Is Dead

A former Minister of Labour and former Chairman of First Bank Nigeria, Ajibola Afonja has died aged 82.

The Oyo-born Prince passed away on Sunday night, May 19 at the University College Hospital, Ibadan, Oyo State.

Confirming the passage of the former Minister in a statement, the Oyo Global Forum (OGF) through its Chairman, Taiwo Adebayo described the late Afonja as a unifier.

“On this dark day in Oyo, we mourn the loss of Ajibola Afonja, former Labour Minister and Chairman of First Bank Nigeria, who passed away on Sunday night, aged 82.

Afonja was Chairman of the Board of Directors of First Bank Plc and was appointed as Minister of Labour under the interim government of Earnest Shonekan.

He was the chairman of Integrated Dimensional System and many other companies. He attended Kingston University, Kingston-upon-Thames, Surrey, United Kingdom where he bagged a degree in Accounting in 1970.
