Ondo Court Dissolves 23-year Marriage As Woman Changes Children Names To Lover’s

A Customary Court sitting in Akure, Ondo state, has dissolved a 23-year marriage between a Lagos-based church founder, Prophet Obayan and wife, Prophetess Chibuzor Obayan, and resolved the paternity of their four children.

The estranged wife, Chibuzor, had changed the names of the children to that of her new lover, who was a former member of the husband’s church.

Prophet Obayan, founder of Divine Prophetic Solutions Prayers Ministryp, had dragged his estranged wife to the court in Akure, to challenge the “snatching of his four children by a member of his church”, and sought the return of the paternity of the children

Obayan had filed a divorce suit against his wife on the grounds that she changed his children’s surname to her lover’s name and the dissolution of his 23-year marriage.

The petitioner told the court that he is a Yoruba man. He accused his wife, who is Ibo from Abia State, of disobedience, misunderstanding, lies, manipulation, abuse, hate and rage.

Obayan prayed the court to grant him the custody of his four children whom his wife had changed their surname to Obi.

During the hearing, the petitioner called three witnesses, including himself, while the respondent and five others testified for the defence.

The respondent’s lawyer, T. B. Odudu, while addressing the court submitted that all the six witnesses she called corroborated their testimonies that there was no marriage between the petitioner and the respondent.

Odudu said that the plaintiff lacked the five elements of customary marriage in Ibo land, which include a treaty, concept of parental agreement, handing over of bride and payment of bride price.

On his part, the petitioner’s counsel, Bosun Otitoju, told the court that his witnesses had testified that there was indeed a marriage ceremony between Obayan and his wife.

Otitoju cited the case of Agbeja (1985) 3 NWLR (Pt.11) 19, which held, “In proof of customary marriage, the evidence of the Head of the family is desirable to prove an eyewitness account of the transaction is essential.”

In his judgement, Magistrate Segun Stephen Rotiba, dissolved the marriage on the grounds that the parties have lost interest in the union.

Magistrate Rotiba said that with regard to relief two in the petition, the Court had already given a well-considered ruling that the children whose custody was sought have already attained adulthood.

According to him, “As regards reliefs three and four, which are ‘inpari material and mutatis mutandis,’ the ruling of the Court dated April 26, 2023, has made a reservation to look into the propriety of the said action in the substantive suit.”

The Court noted that from the evidence before it, the respondent alluded to the fact under cross-examination that since the petitioner did not pay her bride price, her new husband who paid same has the right to have them bear his name in accordance with Ibo custom.

It held further, “In the same breathe, I find the Ibo custom exuded by the respondent and her witnesses that the children of the union can bear Mr Abua Obi as their surname, atavistic, barbaric, evil, ungodly, irrational, unsensational, crass, gross, crude, unwary, provocative, ungodly, discriminatory and insensible.

“The custom that tends to punish one person, when two consenting adults are involved in the act, is nothing but the highest element of insensitivity and servitude.

“I condemn this custom in the strongest terms. While the matter was on, a publication was made on February 2, 2023, changing the surname of the first two children of the parties to Abua Obi.

“Aside the fact that complicit to change the surname of the first two children has been established against the respondent, it also amounts to subjudice as no action is expected to be taken on the subject matter by whoever, when the matter is pending before the Court.

“This is a complete affront to the Court. I say no more. In conclusion, the Court hereby dissolves the union between the parties, having broken down irretrievably.

“The court, hereby, declares personal non grata, the custom of the respondent awarding paternal personality to a man who is not the children’s biological father.

“The court hereby invalidates and renders null and void the publication changing the surname of the 1st and 2nd children from Obayan to Abua Obi.”

Rotiba added that “the court also invalidates any other publication or whatsoever changing the surname of the children from Obayan to Abua Obi during the pendency of this case.”

A yet-to-be-identified man suspected to have taken hard drugs on Tuesday night set his own furniture shop ablaze in the Saniko community, Agbarah-Otor, in Ughelli North Local Government Area of Delta State.

The man, believed to be in his 40s, our source said set the furniture shop containing modern furniture worth millions of naira ablaze, and chased anyone who attempted to intervene with matchett until he was overpowered by the community youths.

Our source who does not want his name in print narrated via the phone: “It actually happened this night. Nobody knows what fell on him to have set his own shop ablaze, but the belief his that he must have taken some hard drugs.

“The man should be in his 40s. He set the shop ablaze, and when people attention was drawn to it, they rushed there but he chased them with cutlass. He was chasing people with cutlass until the youth mobilised and overpowered him, and as I speak with you, he has been tied down, naked.

“I don’t know his name, and nobody has identified with him as a relation, but the point is, millions have been lost. All the modern furniture in the shops have turned to ashes. The shop is completely burnt down.”

Contacted on the phone, Delta State Police Command Public Relations Officer, Bright Edafe said the Command was not aware of the incident.

He said: “Inasmuch he set his own shop ablaze, and nobody died, nobody will come to the Police to report it. And since nobody will come to report such an incident to the Police, it’s assumed the Police are not aware.”

The Nigerian government, through the Minister of Information and National Orientation, Mohammed Idris, has expressed deep shock and sorrow over the tragic death of seven journalists who were confirmed killed in a lone road crash in the Gombe South area of Gombe State on Monday.

The incident occurred on Monday evening as the journalists were returning from a wedding ceremony in the Gombe South Senatorial District. They were said to have traveled in solidarity with a colleague from the Nigerian Television Authority, NTA, who was getting married.

According to preliminary information from the Gombe State Sector Commander of the Federal Road Safety Corps, Samson Kaura, the crash was fatal.

The Minister described the tragedy as a heartbreaking loss to the media community and the nation, noting that the journalists were committed voices who informed the public with courage, integrity, and professionalism.

“This is a harrowing moment. Nigeria has lost dedicated voices who informed, educated, and stood for truth. Their passing is a heavy blow to us all,” he said.

The Minister extended his condolences to the Nigeria Union of Journalists (NUJ), the Gombe State Council, and especially to the families, friends, and colleagues of the deceased. He prayed that God would grant them the strength to bear the painful loss.

“Our thoughts and prayers are with their families and loved ones. May Almighty God grant them comfort and grant the souls of the departed eternal rest,” he added.

“We stand in solidarity with the NUJ and the entire media community at this difficult time. We must continue to work together to improve safety measures for those who serve the nation daily,” he said.

He assured that the Federal Government stands with the bereaved families and the media community during this moment of grief. May the souls of the departed rest in perfect peace.

Large crowds on Tuesday overwhelmed Balogun Market on Lagos Island as residents trooped out in their numbers for last-minute year-end shopping, crippling movement around the commercial hub.

A viral video making the rounds online showed extreme congestion within and around the market, with traders and shoppers barely able to move as they jostled for limited space in one of Lagos’ busiest trading centres.

The footage captured scenes of tightly packed walkways and stalled human traffic, as buyers scrambled to complete end-of-year purchases ranging from clothes and shoes to household items.

The gridlock is largely being blamed on Nigerians’ long-standing culture of last-minute shopping, often described as “panic buying,” where many delay festive purchases until the final days of the year.

Balogun Market, known for its wholesale and retail activities, traditionally experiences a spike in patronage toward the end of the year.

As of the time of reporting, no incidents had been confirmed, though the situation highlights the recurring challenge of overcrowding during peak festive periods in Lagos.
