True Federalism: Expert Wants NULGE Join CSOs, Others For Constitutional Amendment

Professor Festus Imuetinyan, federal Commissioner, Federal Character Commission, Abuja has called on the Nigeria Union of Local Government Employees (NULGE) to join hands with other unions and civil society organizations working for the amendment of the nation’s constitution to make the constitution truly federal.

Imuetinyan made the call on Wednesday in Benin City at the Edo State chapter of NULGE 2022 week celebration with the theme,”Sustaining an autonomous local government as a catalyst for national development: The role of NULGE”.

The university don opined that local governments will only become catalyst for national development when they are put in firm control over local affairs as well as encourage the emergency of local solutions to local problems.

He advocated that the local government matters must be removed from the national constitution and placed within the purview of the states to save them from the challenge of forced uniformity in the face of endemic diversity of local problems.

He added that NULGE, as the major trade union in the local government system in Nigeria, has a duty to ensure that the present unified local government system which is unwieldy is jettisoned.

“Unfortunately, many local government staff are beneficiaries of the present system and do not see any urgent need for changes.

“Your members are the ones that are made sole administrators when elected council heads are illegally sacked by state governments. Many enjoy posting to areas that they are not conversant with the custom and tradition of the people whose problems they are called upon to solve.

“Others are promoted in the face of inadequate utilization of available resources to manage waste and protect public utilities within their jurisdictions.

“It is often alleged that many of your members extort money from members of the public and that they enrich themselves at the expense of the development of the communities”, he said.

He further opined that the present local government system is not patterned to achieve any developmental goal rather than a smooth vehicle for the transfer of centrally collected funds to the pockets of States’ political elites.

Imuetinyan emphasized that the 1999 Constitution makes it possible for state governments to cripple Local Government Councils financially by routing the amount of money standing to the credit of Local governments in the Federation Account (FA) through a joint State Local Government Account rather than directly to local councils.

He asserted that the arrangement adversely affects the fiscal autonomy and viability of most local governments.

According to him, some state governors make inexplicable deductions or unduly delay the release of funds from the joint accounts to local government chief executives.

“Local government chairmen are bullied by state governors to surrender much of their statutory allocations under duress. When they fail; they find other ways to replace them with caretaker committees of selected loyalists.

“Expenditure and project discretion had become a thing of the past. Most states expect their Local governments to seek and obtain permission to embark on projects. Local government projects are inspected periodically by officials of state governments.

“More financial load has been placed on Local governments’ share of the Federation Account. For example, funds for primary school teachers’ salaries and pension charges are now charged centrally to the Local governments.

“The central deductions at source of these charges and several other unfunded mandates in environmental and social spending by the State Governments tend to leave many Local Governments with little funds.

“And unfortunately, many Local governments especially those in the rural areas have limited access to productive tax bases”, he added.

JUST IN: SERAP Drags 36 Govs, Wike To Court Over N5.9tn, $4.6bn Loans

The Socio-Economic Rights and Accountability Project has filed a lawsuit against the governors of the 36 states of the Federation, and the Minister of the Federal Capital Territory, Nyesom Wike, over their failure to account for, and publish the agreements of the N5.9 trillion and $4.6 billion loans obtained by their states and the FCT, respectively.

The suit, numbered FHC/ABJ/CS/592/2024 was filed on Friday on behalf of SERAP by its lawyers – Kolawole Oluwadare, Kehinde Oyewumi and Valentina Adegoke, at the Federal High Court, Abuja.

The statement, which was made available to newsmen on Sunday, asked the court to “direct and compel the governors and Mr. Wike to account for N5.9trn and $4.6bn loans obtained by their states and the FCT and to publish copies of the loan agreements, location of projects executed with the loans.”

The suit is a sequel to SERAP’s demand which was addressed to the 37 respondents in a statement issued by the organisation’s Deputy Director, Kolawole Oluwadare on March 31, 2024.

Kaduna State Governor, Uba Sani, had bemoaned the huge debt inherited from his predecessor, Nasir El-Rufai, on May 29, 2023.

Sani said the state is now left with few amounts, not enough to pay salary, adding that his administration inherited a total of $587m, N85bn and 115 contract liabilities from the ex-governor.

In the statement, SERAP urged the court to “direct and compel the governors and Mr. Wike to invite the Economic and Financial Crimes Commission and the Independent Corrupt Practices and Other Related Offences Commission to investigate the spending of all the loans obtained to date by their states and the FCT.”

In the suit, SERAP is arguing that “it is in the public interest to grant the reliefs sought. Nigerians have the right to see and scrutinise the loan agreements and know the details of how the domestic and external loans obtained by the governors and FCT minister are spent.

“Opacity in the spending of the loans obtained by the governors and Mr. Wike would continue to have negative impacts on the fundamental interests of the citizens.”

The statement noted that many states, including the FCT, “reportedly” spend “public funds which may include the loans obtained by them to fund unnecessary travels, buy exotic and bulletproof cars and generally fund the lavish lifestyles of politicians,” adding that they are “allegedly mismanaging public funds which may include domestic and external loans obtained from bilateral and multilateral institutions and agencies.”

The organisation demanded transparency in the spending of the loans as they are “fundamental to increase accountability, prevent corruption, and build trust in democratic institutions with the ultimate aim of strengthening the rule of law.”

The statement equally noted that the state governors and the FCT minister “cannot hide under the excuse that the Freedom of Information Act is not applicable to their states and the FCT.”

It stated that the “legal obligations to publish the information sought are also imposed by the provisions of the Nigerian Constitution and the African Charter on Human and Peoples’ Rights.”

While no date has been fixed for the hearing of the suit, SERAP lamented that the poverty rate, underdevelopment and lack of access to public goods and services in the country are a result of the “many years of allegations of corruption and mismanagement of public funds including the loans obtained by the states and FCT.”

SERAP quoted the Debt Management Office, saying, “The total public domestic debt portfolio for the country’s 36 states and the Federal Capital Territory is N5.9 trillion. The total public external debt portfolio is $4.6 billion.”

However, SERAP said that the loans – domestic and external, as obtained by the states and the FCT are” vulnerable to corruption and mismanagement,” hence, the respondents “have a responsibility to ensure transparency and accountability in how any loans obtained by the states and FCT are spent, to reduce vulnerability to corruption and mismanagement.”

Coastal Highway: DStv, GOtv Customers To Experience Service Disruptions

DStv and GOtv customers in Nigeria have been notified to expect disruption in service from Sunday, May 5, to Tuesday, May 7, due to the ongoing construction project on the Lagos-Calabar Coastal Highway.

In a notice shared on social media on Friday, DStv assured customers that its technical team will be working to relocate its facility and minimise service disruptions during the process.

The statement read, “Our uplink facility will be impacted by the ongoing Lagos-Calabar Coastal Road construction project. As a result, we are forced to relocate.

“From Sunday, May 5, 2024 to Tuesday May 7, 2024, our technical team will be working tirelessly to relocate and minimise disruptions during the exercise.

“We appreciate your patience and understanding during this period and remain dedicated to delivering the quality service and support you expect from DStv and GOtv.”

The PUNCH reports that demolition for the 700km Lagos-Calabar Coastal Highway commenced on Monday.

According to the Minister of Works, David Umahi, the duration of the construction is eight years, and it will be constructed for N15trn.

12 Years After: Ex-Eagles, Fans Celebrate Late Yekini

Former Super Eagles players and football enthusiasts on Saturday paid tribute to Nigeria’s all-time top scorer, Rashidi Yekini, 12 years after he passed on at 48 after a protracted illness, The PUNCH reports.

The late Yekini was reportedly kidnapped shortly before he passed away, and the cause of his death is still unclear.

Despite his sad ending over a decade ago, there is pride in the achievements of the 1993 African Footballer of the Year, yet sadness at his death and anger at the way he had been treated by the government and football authorities.

Super Eagles coach George Finidi, who made an assist for the late Yekini to score against Bulgaria at the 1994 World Cup in the USA, Nigeria’s first goal in the history of the tournament, said he still feels sad over his untimely death.

“His passing was sad for everyone,” Finidi said in an exclusive chat with Sunday Punch.

“Over the years, I have spoken about him, our connection on the field, and what he did for Nigeria as a player. May his soul rest in peace.”

Former Eagles coach and captain, Sunday Oliseh, a teammate of Yekini, also said his legacies will always be a benchmark for emerging Nigerian players.

“The late Yekini deserves to always be remembered for all he did for our country,” Oliseh told The PUNCH.

“He gave his all to our country, and his exploits are there for us all to see for others to emulate and learn from. May his soul continue to rest.”

“Yekini is definitely one of the best African players and legends to ever walk this earth. Rashidi was full of pace, had a superb shot, could jump very high, and was calm in front of goal. Above all, he was a very loveable person once you got to know and understand him.”

Ace journalist Oluwashina Okeleji also took to his X handle to eulogise the former Victoria Setubal striker.

“Today (Saturday) marks the 12th anniversary of Rashidi Yekini’s death.

“Football lost 1993 African Footballer of the Year Rashidi Yekini at the age of 48. He was Nigeria’s top scorer with 37 goals in 58 games. There was pride in his achievements, sadness at his death, and anger at the way he was treated by some.”

His former club, Gateway United, also joined other Nigerians in celebrating the legacy of Yekini.

Reflecting on Yekini’s illustrious career and his brief stint with Gateway United in 2005, the club’s acting general manager, Niyi Soleye, said, “Rashidi Yekini was not only a prolific goal scorer but also a gentleman that was respected by teammates and opponents alike. His 37 goals for Nigeria remain unmatched, a testament to his talent and dedication.”

Soleye fondly recalled Yekini’s time at Gateway United, describing it as a pivotal moment for the club and their supporters.

“I vividly remember his arrival like it was yesterday. As club secretary then, it was an honour to witness such a calibre of player joining us. He seamlessly adapted to our style, boosting morale both on and off the pitch.”

“While his passing in 2012 under controversial circumstances was tragic, his legacy continues to inspire future Nigerian footballers.”
