An Oredo Chief Magistrates’ Court in Benin Thursday, February 6, remanded a teenager, Marcus Mekpagbe, 18, in Oko Correctional Centre for allegedly raping a 20-year-old girl.
The Chief Magistrate, Patricia Igho-Braimah remanded the accused person in custody and adjourned the case until March 4, for hearing.
Earlier, the Prosecutor, ASP Osayomwanbor Omoruyi told the Court that the accused person committed the offence on Jan. 23, at No 5, Osatohamwen street, Court Rd, in Okada Magisterial District.
Omoruyi said on the said date the accused did forcefully had unlawful carnal knowledge of a 20 years old girl, while she was sleeping without her consent.
The accused person however pleaded not guilty to the one charge of unlawful carnal knowledge
According to the prosecution, the offence contravened section 357 of the Criminal Code , Cap 48,Vol. II, Laws of the defunct Bendel state of Nigeria 1976 as applicable in Edo.
The police Prosecutor objected to bail application on the grounds that the offence is not a bailable offence.
