‘My Husband Refused To Work, Took To Excessive Drinking, Smoking After He Returned From South Africa’

A woman, Simbiat, has filed for the dissolution of her 11-year-old marriage to her husband, Abass, at the Grade A Customary Court sitting in Mapo, Ibadan, Oyo State, citing lack of care and affection, irresponsibility, laziness, excessive drinking, and smoking as reasons for her action.
Simbiat explained that she met Abass in South Africa, where he impregnated her during their relationship.
She stated that both families later conducted an introduction ceremony in Nigeria, after which they began living together as husband and wife.
According to Simbiat, her husband displayed irresponsible behaviour from the beginning of their union, and his conduct deteriorated further after they relocated to Nigeria.
She alleged that Abass became unwilling to work and rejected every job opportunity offered him.

She further told the court that she had been solely responsible for catering to the family’s feeding and other needs because of her husband’s neglect. Simbiat also accused Abass of frequently drinking to excess and smoking heavily almost all the time.
The plaintiff stated that she eventually left their matrimonial home after becoming frustrated with her husband’s attitude to life, adding that they had lived separately for more than four years.
Simbiat appealed to the court to grant her custody of their children and order Abass to contribute to their welfare. She specifically requested N50,000 for the feeding of their two children.
Abass, however, was absent from court despite being served with court summons.
Simbiat, while testifying before the court, said, “I regret ever marrying my husband because our union has brought me nothing but sorrow and hardship.

“I met Abass during my stay in South Africa, and we began a relationship which later resulted in my pregnancy.
“I informed both him and my parents in Nigeria about the development, while he also notified his family.
“Both families held an introduction ceremony on our behalf, after which we started living together as husband and wife.
“From the very beginning of our marriage, my husband showed signs of irresponsibility.
“He abandoned his responsibilities as the head of the family and failed to take care of me and our child.
“Even when I became pregnant with our second child, his attitude did not improve.

“Things became worse after we relocated to Nigeria.
“My husband became lazy and unwilling to work.
“He rejected every job opportunity that came his way, leaving me with the responsibility of taking care of the home and providing for the family alone.
“Abass also became irrational in his behaviour and hardly made reasonable decisions concerning the family.
“He took to excessive drinking and often drank himself into a stupor.
“In addition, he became heavily addicted to smoking, finishing several packets of cigarettes daily.

“The more I complained about his behaviour, the worse he became.
“I eventually moved out of our matrimonial home more than four years ago because I could no longer cope with the frustration he caused me.
“Since then, he has neither checked on the children nor contributed to their upkeep.
“I am therefore pleading with the court to dissolve our marriage and grant me custody of the children.
“I also appeal to the court to compel my husband to take responsibility for the children’s welfare, especially their feeding, education, and healthcare.
“I am requesting the sum of N50,000 monthly for their feeding.”

Delivering judgment, the president of the Grade A Customary Court, Mrs. S. M. Akintayo held that a valid customary marriage existed between the parties since an introduction ceremony was conducted by both families, and the bride price was duly paid.
Akintayo noted that the plaintiff had made it clear that she was no longer interested in continuing the marriage, citing the defendant’s excessive drinking and smoking habits, among her reasons.
She further stated that the evidence presented by the plaintiff was neither unchallenged nor contradicted because the defendant failed to appear before the court to defend himself.
According to the court president, the court had no option but to grant the plaintiff’s requests, especially as the couple had reportedly lived apart for more than four years.
Akintayo consequently dissolved the marriage. She awarded custody of the children to the plaintiff and ordered the defendant to take responsibility for their upkeep.

My Wife Destroyed My Property, Instigated Our Children To Beat Me, Man Tells Court

The Grade A Customary Court, Court 2, sitting in Mapo, Ibadan, Oyo State, has delivered judgment in a divorce suit filed by a man, Theophilus, against his wife, Aina, whom she accused of lack of affection, frequent quarrels, and domestic violence.
According to Theophilus, Aina was stubborn and always insisted on having things her own way.
He further said that she was disobedient and refused to listen to him.
The plaintiff also told the court that the defendant was hostile towards their friends and neighbours, which often led to conflicts between them.

He further claimed that Aina was violent and would attack him with any object within her reach during disagreements.
In addition, he accused her of destroying his property whenever they had differences.
Theophilus also explained that Aina turned their children against him.
He stated that they assaulted him and damaged his belongings.
He told the court that he eventually left their home because he feared for his safety and believed that the defendant intended to harm him.

The plaintiff therefore appealed to the court to dissolve their marriage and also requested an order restraining Aina from threatening him or interfering with his privacy.
Aina was absent from court despite being served court summons.
Theophilus, while giving his testimony before the court, stated, “I have not enjoyed peace or rest of mind since I married my wife.
“I paid her bride price to her family, but they rejected it.
“My wife is far from being a virtuous woman.
“She was never submissive and was always full of herself.

“She had no respect for me and disobeyed my instructions whenever she wished.
“She neither listened to me nor accepted my advice.
“My wife was also violent.
“During disagreements, she attacked me with any dangerous object she could lay her hands on.
“On three different occasions, Aina destroyed my property.
“Our neighbours and friends were not exempt from her hostility.

“She was constantly at loggerheads with them and fought with them on several occasions.
“My wife also turned our children against me.
“They beat me mercilessly and nearly killed me.
“They also destroyed my belongings.
“I left the house after the incident because it became obvious that my wife wanted me dead.

“I came to court to seek the dissolution of our marriage because my wife’s presence in my life has brought me nothing but pain and suffering.
“I sincerely appeal to the court to dissolve our marriage.
“I also request an order restraining her from threatening me or interfering with my privacy.”
The Court President, Mrs. O. E. Owoseni, while delivering judgment, stated that there was no valid marriage to dissolve because no marital rites were performed, and no bride price was paid.
Owoseni also issued an order restraining the defendant from threatening or interfering with the plaintiff’s private life

‘I Have Nowhere To Go, He Married Me At 14yrs Old, Now He Wants Divorce 30yrs After’

A 44-year-old woman, Zainab Isah, has told a Shari’a Court 1 sitting at Magajin Gari, Kaduna, Kaduna State, that she had nowhere to go after her divorce from her husband, Alhaji Abdulhamid.
According to the News Agency of Nigeria (NAN), Zainab told the court that Abdulhamid married her when she was 14 years old.
“I have been married to him for 30 years now and our union is blessed with 10 children,” she stated.
She further said that her husband divorced her on January 1.

“I am yet to complete my waiting period (Iddah), as required under Islam.
“I lived in peace with my co-wives but I can’t leave my children for them; three of my children are sick,” she said.
Earlier , Abdulrashid Musa, counsel to Abdulhamid, prayed the court to compel Zainab to leave his house since they were no longer married.
He said he had issued two pronouncement of divorce to the defendant.

The first, he said was pronounced on December 29, 2025, adding that she had finished her Iddah.
He stated that all efforts made by him to ensure she leaves his house, failed.
He alleged that she was causing trouble for his other wives.

The complainant however, told the court that he was ready to pay for his ex wife’s rent when she gets a new place to live with her children.
The judge, Malam Mu’awiya Shehu said the rights of a woman for shelter, feeding and other provisions by the husband ends when divorce occur adding that only the children have the right to be taken care of .
He adjourned the matter to June 1 for the defendant to find a new place she can relocate to with her children.

My Husband Refused To Consummate Our Marriage Five Months After We Got Married, Woman Tells Court

A housewife, Jamila Hussaini, has approached an Upper Area Court sitting in Mararaba-Gurku, Nasarawa State, seeking the dissolution of her marriage to her husband, Ahmed Muhammad, over claims of non-consummation of their marriage and trauma.
Jamila, who resides at Masaka, in Karu area of Nasarawa State, filed the petition on April 17, against her husband.
The petitioner told the court that she was married to Ahmed who resides in Abuja, under Islamic Law.

She averred that since their marriage on December 27, 2025, the respondent had not taken her to his house or even provided her with shelter.
According to the petitioner, she had remained in her parents’ house since the marriage was contracted, adding that it has not been consummated.
The petitioner also claimed that she had been traumatised by the respondent, adding that she had lost all love and affection for him.
She, consequently, sought an order for the dissolution of their union and for any other order the court may deem fit to make in the circumstances of the case.

The respondent was absent in court, but he sent a divorce letter for the court to proceed and pronounce a single divorce according to Islamic Law.
The presiding judge, Mohammed Yakubu, consequently, granted dissolution of the union, following mutual consent of the parties.
The court, however, ordered that the petitioner should observe a three months waiting period (‘Iddah) according to Islamic law before she contracted another marriage.
